In compliance with national and international regulations governing e-commerce, our aim is to enable consumers - potentially all over the world - to purchase furnishing items online.
WHEREAS
The Customer declares and warrants
that he/she is of legal age; that the data provided by him/her for the execution of the Contract are correct and true; that, whenever he/she makes a purchase, he/she has read the Privacy Policy, the Cookie Policy, the Shipping and Returns Policy and the General Terms and Conditions of Sale, specified below, and accepts them.
The General Terms and Conditions of Sale are governed by Italian law and in particular by Legislative Decree No. 206 of 6 September 2005 on the Consumer Code, with specific reference to the regulations on distance contracts, and by Legislative Decree No. 70 of 9 April 2003 on certain aspects of e-commerce.
The following General Terms and Conditions of Sale may be amended by Tendeevolution, without any prior notice, also in consideration of possible regulatory changes.
Any new General Conditions of Sale shall be valid from the date of publication on tendeevolution.it and shall be applied to sales concluded after the new disclosure.
The following General Terms and Conditions of Sale do not regulate the provision of services or sale of products by parties other than Tendeevolution that may be present on the website tendeevolution.it through links, banners or other hypertext links.
Orders
The conditions of sale in force are deemed to be expressly accepted by the Customer at the time when he completes, following the relevant instructions, the order form in electronic format and transmits it electronically to Tendeevolution.
Failure to provide or the incorrect provision of data necessarily entails the impossibility of fulfilling the obligations arising from the sales contract that may have been concluded.
The order, only if completed in all its parts and if accepted, shall be filed in Tendeevolution's database for the period of time necessary for its processing and in any case within the terms provided for by law.
Since an order form may contain products of different kinds, the delivery times of the individual products that make up the same order may be different, as indicated on the individual products.
For this reason, without prejudice to what is agreed below in the Right of Withdrawal clause, the Customer undertakes to accept any delivery at different times, waiving the right to claim any compensation and/or indemnity.
Tendeevolution undertakes, in accordance with the law, to promptly inform the Customer of the possible unavailability of the ordered product and jointly, without prejudice to what is agreed below in the Right of Withdrawal clause, also undertakes to propose to the Customer reasonable alternative solutions.
Tendeevolution shall send the Customer, by email, for all products purchased, an order summary (ORDER DETAILS).
The Order Summary shall contain information relating to the purchased products, including, unit and total price, means of payment and expected transportation costs.
Prices
The prices shown for each item offered for sale by Tendeevolution on the website are in Euros and are intended to the public including VAT and packaging, excluding shipping costs. Tendeevolution reserves the right to change the prices indicated in the pages of its website without prior notice.
In the event of price list increases occurred after the acquisition of orders not yet processed, Tendeevolution will still apply the prices in place on the site at the time of the order.
Payments
All orders shall be deemed to have been acquired once payment has been completed.
Payments are always inclusive of transport costs.
Tendeevolution accepts payments by PAYPAL ACCOUNT, by CREDIT CARDS (VISA, MASTERCARD, VISA ELECTRON, MAESTRO, V-PAY, AMERICAN EXPRESS, JCB, UPI) on a secure circuit, and by Bank Transfer in Advance.
In the event of payment by ANTICIPATED BANK TRANSFER, to be made in favour of Tendeevolution. - Iban: IT65A08952819500000006509 indicating in the reason for payment the order number and name of the order holder, the goods will be dispatched only after the administrative confirmation of payment. After 10 days from the order, if the ADVANCE BANK TRANSFER has not yet been made, the order will be automatically cancelled.
In the event of payment by CREDIT CARD, the financial information (e.g. the credit/debit card number or the date of its expiry) will be forwarded, via encrypted protocol, to the secure circuits and Paypal that provide the relevant remote electronic payment services, without third parties being able, in any way, to access it.
Such information, moreover, will never be known to Tendeevolution.
In the event that reimbursement operations procured by the return of products as a result of exercising the right of withdrawal, Tendeevolution will put in place through the banking circuits agreed, the procedures necessary for the successful completion of reimbursement.
Tendeevolution shall issue all tax documents together with the delivered goods.
Deliveries and shipping costs
Italy
Attention: Upon delivery of the products, the Customer is required to check:
* that the number of packages corresponds to the transport document
* that the packaging is intact, undamaged, and with the seals intact
Any damage to the packaging and/or the product, or the mismatch in the number of packages, must be immediately detected, by affixing a specific reason for return/not taking charge on the product delivery document to be returned to the courier.
Once the package has been opened, any problems concerning the physical integrity of the items ordered must be reported to Tendeevolution Customer Service by email to info@tendeevolution.it or by telephone to 3345026558.
Delivery time: within 48/72 working hours, delivery c/o address specified in the order.
Complaints and returns
Tendeevolution is willing to acknowledge any kind of problem found upon receipt of the goods (defective items or items not meeting expectations)
Methods of use
Tendeevolution disclaims any liability in case of improper use of the products offered for sale. Tendeevolution may not be held liable for any damages, direct or indirect, suffered by the Customer for the incorrect or improper use of the product.
Right of Withdrawal
Pursuant to Article 52 of Legislative Decree 005, as amended by Legislative Decree 1/2014, the Customer may withdraw from the purchase contract for any reason whatsoever within a total of 14 (fourteen) days from the date of receipt of the products.
An exception is made, according to Article 59 of the Consumer Code, for the "supply of goods made to measure or clearly customised".
The right of withdrawal will be fully taken over by the Company if the product has any quality or production defects.
NOTE: Should the return be requested for other reasons, the Customer shall have to send the product back to Tendeevolution at OWN EXPENSES within 14 (fourteen) days from receipt of the goods, the Customer Service shall inform the Customer of the destination address for the returned goods.
WARNING: The goods must be returned intact, complete with all its parts, and in its original packaging, without any signs of wear or dirt or incorrect and improper use of the product, during the period of possession of the same by the Customer, in full compliance with the conditions set out below:
Privacy
The Personal Data collected with the submission of the Order shall be processed by Tendeevolution for the sole purpose of satisfying the express requests of the Customer, in accordance with Legislative Decree 196/2003 and the privacy policy on the website.
Copyright
Trademarks, logos and other distinctive signs present on the website belong to their respective owners. Therefore, the use of trademarks, logos and other distinctive signs, including their reproduction on other websites by unauthorised third parties, is FORBIDDEN. The contents of the site are protected by copyright (text, images and graphics).
